ISSUES OF IMPROVING THE PRINCIPLE OF ESTABLISHING THE TRUTH

Abstract

This article analyzes the principle of establishing the truth, which is one of the fundamental pillars of criminal procedural law. Initially, it explores the general philosophical and linguistic interpretations of the concept of "truth," comparing its objective, relative, absolute, and formal types. Furthermore, based on the current Code of Criminal Procedure and the resolutions of the Supreme Court Plenum, the legal mechanisms for establishing the truth and the obligations of investigative and judicial bodies in this regard are examined. At the conclusion of the article, a scientific and legal proposal is put forward to rename the existing principle to the "Principle of Establishing Objective Truth" to eliminate ambiguities in legislation and improve the quality of justice.
