Abstract

This article examines the legal mechanisms for protecting the rights and legitimate interests of persons affected by domestic (family) violence. It analyzes the legislation of the Republic of Uzbekistan aimed at preventing and combating domestic and family violence, including the provisions of the Law of the Republic of Uzbekistan “On Protection of Women from Harassment and Violence,” the Family Code, the Civil Code, and the Criminal Code, with particular attention to their systemic interaction and practical application.

Special attention is given to judicial mechanisms for protecting the violated rights and legitimate interests of victims, including the protection of their family, property, and personal non-property rights. From a comparative legal perspective, the article examines the experience of England and Wales, Spain, and the Scandinavian countries in preventing domestic (family) violence, ensuring the safety of victims, and providing effective judicial remedies.

Based on the analysis, the article identifies certain shortcomings in the legal regulation and law-enforcement practice of the Republic of Uzbekistan. It also develops proposals aimed at improving national legislation and judicial mechanisms for protecting persons affected by domestic (family) violence, including strengthening the effectiveness of protective measures, improving judicial response procedures, and ensuring comprehensive protection of victims’ property and personal non-property rights.
