Abstract

This scientific study examines the socio-legal and criminal-legal aspects of mercenarism in the context of modern armed conflicts. It analyzes the threats posed by mercenarism to international peace and security, state sovereignty, as well as human rights and freedoms. The study examines the criminal law provisions of the Criminal Code of the Republic of Uzbekistan governing liability for mercenarism and enlistment in the military and other special formations of foreign states, as well as their compliance with the norms of international law. Furthermore, the study explores the concept of a mercenary and the legal characteristics of the recruitment, training, financing, and use of mercenaries. Based on the results of the study, scientific and theoretical conclusions and proposals have been developed aimed at improving criminal-law mechanisms for combating mercenarism, ensuring the proper legal qualification of relevant acts, and further developing national criminal legislation in accordance with international standards.
