ПРАВОВАЯ ПРИРОДА ОКАЗАНИЯ ЮРИДИЧЕСКОЙ ПОМОЩИ ЗА СЧЁТ ГОСУДАРСТВА ПРИ ДОСУДЕБНОМ ПРОИЗВОДСТВЕ ПО УГОЛОВНОМУ ДЕЛУ

В статье с концептуально-правовой точки зрения анализируется правовая природа и значение института оказания юридической помощи за счёт государства в досудебном производстве по уголовному делу. Юридическая природа данного института изучена путём анализа статьи 29 Конституции Республики Узбекистан, Закона «Об оказании юридической помощи за счёт государства», Уголовно-процессуального кодекса и постановления Кабинета Министров № 774. Опыт Германии, Великобритании, Франции, Казахстана и России сопоставлен с узбекской моделью. Предложены конституционный, процессуальный, организационно-договорный и финансово-бюджетный пласты, а также критерий «возможности отказа от защиты», направленные на определение правовой природы института и обоснование его значения как процессуальной гарантии.
