АКУТАЛЬНЫЕ ВОПРОСЫ ОБЕСПЕЧЕНИЯ ПРАВА ГРАЖДАН НА УЧАСТИЕ В УПРАВЛЕНИИ ДЕЛАМИ ОБЩЕСТВА И ГОСУДАРСТВА

В статье исследуются содержание права граждан Республики Узбекистан на участие в управлении делами общества и государства. В ходе изучения было обращено внимание на отсутствие некоторых форм публичного участия в данном праве и его несоответствие определению субъективного права. Автор объясняет эти особенности разнообразием взглядов на демократию и выдвигает идею о том, что данное право надо понимать в широком и узком смыслах. Наличие права участвовать в ведении государственных дел в узком смысле является правовой основой для возложения на органы государственной власти обязанности вовлекать граждан в свою деятельность. В целях выполнения этой обязанности публичными органами обосновано формирование при них общественных советов, обеспечение присутствия и участия граждан в их открытых заседаниях и других форм публичного участия, а также создания для этого необходимых условий.
