THE ROLE AND PLACE OF THE CIVIL CODE OF THE REPUBLIC OF UZBEKISTAN IN THE HIERARCHY OF REGULATORY LEGAL ACTS AND CONCEPTUAL PROBLEMS OF IMPROVING CONTRACTING RELATIONS UNDER CHAPTER 37 “CONTRACTING” OF THE CIVIL CODE OF THE REPUBLIC OF UZBEKISTAN

This article, based on a new approach, highlights for the first time the role and place of the Civil Code of the Republic of Uzbekistan in the hierarchy of regulatory legal acts, as well as conceptual problems of improving contractual relations under Chapter 37 “Contracting” of the Civil Code of the Republic of Uzbekistan. Of particular importance is the relationship between the Code and the law in the context of the digital transformation of civil law. At the same time, the prospects for improving the norms of the Civil Code of the Republic of Uzbekistan on the legal regulation of contractual relations in the system of law of obligations have been studied. In addition, conceptual problems were explored based on the essence of the tasks aimed at ensuring the implementation of the Decree of the President of the Republic of Uzbekistan dated 04/05/2019 No. F-5464 “On measures to improve the civil legislation of the Republic of Uzbekistan.” It also describes issues related to the current trend of digitalization of contractual relations. Especially, international, foreign and domestic scientific and legal sources and special legal documents related to the research topic are analyzed. The most remarkable thing is that, taking into account the best experience of some foreign countries, in the process of reforming the Civil Code of the Republic of Uzbekistan, well-founded conclusions and proposals for improving contractual relations were developed.
