THE CONCEPT OF MARRIAGE AND CHARACTERISTICS OF FAMILY RELATIONS IN PRIVATE INTERNATIONAL LAW

The article examines the specifics of regulating marital and family relations involving a foreign element within the framework of private international law. It highlights the relevance of legal regulation concerning marriage, divorce, annulment of marriage, as well as property and personal non-property relations between spouses and between parents and children when foreign citizens or stateless persons are involved. The article analyzes conflict-of-law rules applicable in cases of discrepancies between the legislations of different countries. The importance of choice of law and jurisdiction in the presence of an international element is emphasized. The approaches of various scholars to defining the subject matter of private international law are also discussed, underscoring the significance of applying conflict-of-law methods to ensure fair law enforcement in cross-border relations.
