LEGAL STATUS AND ROLE OF THE WITNESS IN CIVIL PROCEEDINGS

This article is devoted to the study of the legal status of a witness in civil proceedings, their role in the judicial process, and the significance of their testimony in establishing the factual circumstances of a case from both scientific and practical perspectives. The article analyzes the functions of a witness as a participant in the procedural process, their rights and obligations, as well as issues of liability in cases of providing false testimony or failing to comply with procedural rules. The impact of the reliability of witness testimony and its consistency with other evidence on the court’s decision-making is examined. In addition, the article highlights the key aspects of ensuring equality of the parties, transparency of the proceedings, and the fair resolution of disputes through the participation of witnesses in the judicial process.
