CONCEPT, ESSENCE, AS WELL AS CRIMINOLOGICAL AND LEGAL ASPECTS OF ORGANIZED CRIME

The article provides a comprehensive analysis of the modern concept, socio-legal, and criminological nature of organized crime, as well as its transformational features in cyberspace and the transboundary environment. Based on a comparative analysis of doctrinal views, methodological and jurisdictional/conflicting issues between positive criminal law and academic criminology are revealed. As a result of the research, the author's conceptual definition has been developed, systematizing fundamental characteristics of organized crime such as hierarchical subordination, high-level conspiracy, corruptive protection, the use of crypto-assets, and the laundering of criminal capital. This theoretical and practical model serves as a scientific and methodological foundation for operational-search authorities to disintegrate criminal structures and improve strategies to combat them.
