RELATIONSHIP BETWEEN TRADEMARK AND TRADE NAME RIGHTS

The place of a trademark and trade name in economic activity is considered, a comparative legal analysis of the means of individualization of a trademark and trade name, their legal nature is carried out. A general description of each of these institutions is given, their distinctive features, the procedure for registering a trademark and trade name are analyzed. Procedure for clarifications and registrations under national legislation and international conventions, also, pre-trial legal measures to protect the rights of trademark holders, company names, and a judicial method of protecting rights were introduced.
