FUNCTIONS OF THE CRIMINAL PROCESS AS A DIRECTION OF PROCEDURAL ACTIVITY

This article discusses the criminal procedure functions as the fundamental basis of the criminal process. Also, the concept of a function, their interaction (ratio), theoretical and practical implementation is considered. The allocation in criminal procedure law of functions takes place in accordance with the specific objectives of the procedural activity and within the framework of a single plan. It is concluded that the function of the criminal process should be understood as the property of the criminal justice system that ensures the implementation of the main activities carried out by the participants in the process in accordance with their role and purpose in the field of criminal proceedings. The functions that determine the type of activity and the tasks to be solved are closely interconnected. However, in the criminal procedure law there is no clear definition of the functional tasks of the bodies and officials involved in the application of substantive and procedural law.
