ISSUES OF RETROACTIVE EFFECT OF THE CRIMINAL LAW MITIGATING PUNISHMENT

According to article 13 of the Criminal Code of the Republic of Uzbekistan, the law mitigating punishment is retroactive. However, the concept of a law mitigating punishment or increasing punishment is not given. Moreover, the legislation does not specify how such laws should be defined. In this article, the author, focusing on the changes made to the criminal law, raised the question of how to proceed with the reduction of punishment by the new law, changes in criminal legislation in different directions, presented his proposals that it is advisable to introduce into the legislation.
