Abstract

As we all know, the institution of criminal punishment is considered from the point of view of two legal systems. The first of them is Anglo-Saxon, and the second is Romano-Germanic. The Anglo-Saxon legal system is represented by the law of countries such as England and the USA; and the Romano-German legal system with the legal system of countries such as Germany, Denmark, Poland, and Sweden. The fundamental difference between the institution of criminal punishment in the Anglo-Saxon system and the Romano-Germanic system is that the main source of law and legislation is general or judicial practice. Community service is the most common form of punishment in Western European countries. This type of punishment, like the punishment of correctional work, is considered a punishment that is not related to deprivation of liberty, and with some elements it resembles the punishment of correctional work. Let's get acquainted with the role of these types of punishment in English law below. Based on this, the place of correctional work, which is considered one of the types of punishment, in the criminal legislation of foreign countries, the identification of the specific features of this type of punishment in the legal system of the countries, and the analysis of the similar and different aspects between them are necessary for the further improvement of the penal system, its further improvement. is important in its fair application.
