ПРАВОВЫЕ И ИНСТИТУЦИОНАЛЬНЫЕ ОСНОВЫ ФОРМ РАЗМЕЩЕНИЯ ДЕТЕЙ-СИРОТ И ДЕТЕЙ, ОСТАВШИХСЯ БЕЗ ПОПЕЧЕНИЯ РОДИТЕЛЕЙ

В данной научной статье на основе комплексного подхода анализируется система альтернативного размещения детей-сирот и детей, оставшихся без попечения родителей, а также действующие формы её реализации. В ходе исследования рассматриваются нормативно-правовые акты, регулирующие данную сферу, их содержание, практика применения законодательства, а также раскрывается значение институциональных и законодательных реформ последних лет, направленных на совершенствование системы защиты прав детей в Республике Узбекистан. В статье проводится сравнительный анализ таких форм альтернативного размещения, как опека и попечительство, передача на воспитание (патронат) и усыновление, с институциональными формами ухода, а также обосновываются правовые и социальные аспекты семейно ориентированного размещения с точки зрения обеспечения наилучших интересов ребёнка. При этом подчёркивается, что воспитание детей в условиях, максимально приближённых к семейной среде, является важным фактором их социальной адаптации и всестороннего развития. Кроме того, анализируется роль центров социальных услуг «Инсон» в качестве органов опеки и попечительства, а также полномочия Социальной инспекции по защите прав детей, осуществлению контроля за соблюдением законодательства и применению мер административного наказания по делам об административных правонарушениях, включая механизмы ответственности.
