Abstract

This article provides a comprehensive analysis of the legal nature of enforcement documents of a non-proprietary nature, the criteria for distinguishing them from proprietary claims, their functional types, and the general conditions for applying compulsory enforcement measures. Non-proprietary enforcement claims are substantiated not merely as demands excluding monetary recovery, but as an independent category of enforcement aimed at creating, restoring, altering, eliminating, or preserving a specific non-monetary legal or factual outcome. It is demonstrated that classifying claims based on the nature of the required conduct, the debtor's personal involvement, the possibility of performance by a third party, and the duration of the result holds direct practical significance for selecting the appropriate enforcement method. The enforceability of the court document, the objective possibility of enforcement, notification, proportionality, and the procedural recording of the outcome are interpreted as interconnected conditions for compulsory enforcement. It is noted that while open statistics regarding enforcement practice in Tashkent city for 2025 reveal a significant volume of non-proprietary enforcement cases, data from this specific region cannot be generalized to represent the national figure. The article presents a comparative analysis of approaches—drawing on the legislation of Germany and Estonia—to distinguishing between obligations that must be performed personally and those that may be performed by another person. In conclusion, it is proposed that the effectiveness of enforcement be evaluated not by the number of sanctions applied, but by the actual, complete, and stable achievement of the legal and factual outcome specified in the court document.
