ISSUES OF IMPROVING PROSECUTORIAL SUPERVISION OVER THE ENFORCEMENT OF LAND LEGISLATION IN THE AGRARIAN SECTOR IN THE DIGITAL ENVIRONMENT

The article examines the factors that reduce the effectiveness of prosecutorial supervision over the enforcement of land legislation in the agricultural sector: late detection of violations, fragmentation of departmental information systems, and the undefined legal status of remote sensing data. The views of national and foreign scholars are compared on four contested issues: the legal nature of remote sensing data, the level of legal act at which digital tools should be enshrined, the sufficiency of interagency integration, and the criteria for selecting objects of inspection. The author argues that in the digital environment the direct subject of prosecutorial supervision is the discrepancy between the legal status of a land plot recorded in registries and its actual condition as shown by remote sensing data, and distinguishes three types of such discrepancy. On this basis, the article proposes an eight-stage organizational and legal mechanism, the «YER PROKUROR» information and analytical program, amendments to the Land Code (a new Article 85¹ and an addition to Article 14), and criteria for assessing the effectiveness of the proposed model.
