THEORETICAL ASPECTS OF THE FORMATION OF THE LEGAL FRAMEWORK FOR THE ADMINISTRATIVE COURT SYSTEM IN THE REPUBLIC OF UZBEKISTAN

This article examines the formation of the legal framework for the administrative court system in the Republic of Uzbekistan through an analysis of domestic legal scholarship and international academic literature. The study aims to identify the stages of development of administrative courts as an institution and trace changes in the theoretical approaches to their study. The analysis employs historical-legal, comparative, and systemic approaches, together with the analysis and synthesis of scholarly literature. The legal nature of administrative courts is examined through the interrelationship between judicial review of public administration and the protection of individuals whose rights have been violated. The article identifies a shift in domestic legal scholarship from general theoretical issues of administrative law towards the study of specialised courts, procedural mechanisms, and the practical effectiveness of judicial protection. It argues that judicial independence, procedural quality, clarity of jurisdiction, enforcement of judgments, and consistency of judicial practice should be examined as interconnected factors when assessing the administrative court system. The article concludes that educational and scholarly literature on administrative law should be enriched through the incorporation of judicial practice and case analysis.
