THE TREATY-BASED LEGAL FRAMEWORK FOR THE INTERNATIONAL REGULATION OF ARTIFICIAL INTELLIGENCE

The international legal regulation of artificial intelligence at the global level is currently one of the key issues being addressed within the United Nations. The UN International Law Commission and the UN global scientific body are advancing the concept of maintaining the human element in decision-making processes involving artificial intelligence, while focusing on risk assessment and the assurance of technological safety. To date, no convention establishing a universal (global) legal framework for artificial intelligence has been adopted. Nevertheless, within the realm of international law and grounded in the UN Charter and generally accepted norms of international law key universal instruments include UN resolutions, the UN Convention on Combating Cybercrime, the “Pact for the Future”, the “Global Digital Compact”, the “Declaration on Future Generations”, and recommendations issued by UNESCO and the Organization for Economic Co-operation and Development (OECD). As a result of technological advancements, international information security has emerged as a new field within international relations; currently, international legal experts are addressing issues regarding the legal regulation of information and communication technologies and the development of relevant international standards and principles. This article analyzes universal and regional models for regulating artificial intelligence in the sphere of information security and proposes the adoption of an international standard that incorporates norms concerning information security.
