SOME ISSUES OF REGULATING THE COLLECTIVE MANAGEMENT ACTIVITY OF PROPERTY RIGHTS UNDER COPYRIGHT

Abstract

This scientific article argues that due to the possible difficulties of copyright enforcement in the new high-tech fields of use of works, various schemes of collective management of rights are the basis for increasingly widespread use. Due to this, instead of signing contracts with many authors and other rights holders, users of works and related rights have the opportunity to sign a contract with a specialized organization that represents their interests and is called "collective copyright management". Also, this work examines the history of the creation of the Copyright Protection Institute, the powers, functions and types of collective management organizations, the difference between the collective management of copyright and the concept of representation. Also, within the scope of the topic, to conclude contracts with persons who use works (objects of authorship and related rights) on their own behalf based on the powers granted by collective management organizations; collection, distribution and payment of fees to copyright holders are also explored in detail. Attention is paid to some current problems related to the improvement of this institution, international standards of copyright protection and comparative legal analysis of national legislation, as well as the opinions of scientists of Uzbekistan and other countries. Proposals and recommendations of scientific and practical importance for the development of copyright were put forward.
